ENFORCEMENT SUMMARY

CHARGES
On June 21, 2007, Judge Collerman of The Provincial Court of Manitoba accepted the guilty plea of MARWEST MANAGEMENT CANADA LTD. (“Marwest”) to a violation of section 14 of Manitoba Regulation 57/88 (the “Regulation”) a Regulation under The Real Estate Brokers Act (“REBA”).
SUMMARY
Marwest failed to comply with the Regulation, and did thereby commit an offence under subsection 42(3) of REBA, by failing to file an annual trust account report within four months of its financial year ending October 31, 2006. Marwest filed the required report on April 3, 2007 after being notified its registration was suspended effective March 21, 2007 for failure to file the required report. Marwest’s registration was reinstated April 4, 2007.
SENTENCE
The court imposed a fine in this instance of $500.00. Costs and applicable surcharges were imposed in the amount of $315.00. Marwest was given until July 15, 2007 to pay the fine, costs and applicable surcharges.
