APPENDIX G NATIONAL INSTRUMENT 81-104 COMMODITY POOLS AMENDMENT INSTRUMENT 1. Section 1.1 of National Instrument 81-104 Commodity Pools is amended by adding the following after the definition “Derivatives Fundamentals Course”: “independent review committee” means the independent review committee of the investment fund established under National Instrument 81-107 Independent Review Committee for Investment Funds;”. 2. Section 9.2 of National Instrument 81-104 Commodity Pools is amended by adding the following after subsection 9.2(o): “(p) provide the disclosure concerning the independent review committee of the commodity pool that is required to be provided by a mutual fund under (i) subsection 3.1 of Item 5 of Part A of Form 81-101F1 Contents of Simplified Prospectus, (ii) subsection 3.1 of Item 8 of Part A of Form 81-101F1 Contents of Simplified Prospectus, (iii) subsections 2.1 and 2.2 of Item 4 of Form 81-101F2 Contents of Annual Information Form, (iv) paragraph (h) of Item 10.1 of Form 81-101F2 Contents of Annual Information Form, (v) subsection 6 of Item 11.1 of Form 81-101F2 Contents of Annual Information Form, (vi) subsection 1 of Item 12 Form 81-101F2 Contents of Annual Information Form, and (vii) subsection 2 of Item 15 of Form 81-101F2 Contents of Annual Information Form in connection with the independent review committee.” 3. This Instrument comes into force on November 1, 2006.
