MSC Notice 2002-7 The Commodity Futures Act Sections 14(1) & 15(1) Winnipeg Commodity Exchange Inc. and WCE Holdings Inc. Application for registration as an exchange Application for recognition as a self-regulatory organization Section 16(1) WCE Clearing Corporation Application for designation as clearinghouse of Winnipeg Commodity Exchange Inc. The Manitoba Securities Commission is publishing for comment the applications described above which were received by the Commission on March 4, 2002. The applications are attached to this notice. The Winnipeg Commodity Exchange was first registered as an exchange under the Act and was recognized as a self-regulatory organization as of the date of proclamation of the Act, February 1, 2000. WCE Clearing Corporation was designated as the clearinghouse of the exchange on that date. Following the demutualization of the exchange into WCE Holdings Inc. and Winnipeg Commodity Exchange Inc. the Commission issued an interim order dated November 29, 2001. The interim order permits the exchange to conduct business pending a review of its new structure. This interim order expires March 31, 2002. The Commission is now inviting comment prior to final decisions being made on the applications. Comments received on or before Friday March 22, 2002 will be considered. Submissions may be made by e-mail or by way of letter. Letters must include an electronic version of the comments in Word format. If the Commission determines the comments received do not require changes to the application it is expected that the Commission will make a decision as to whether to approve the applications on or before the expiry of the interim order, March 31, 2002. If comments raise issues that require further review or amendment to the application, it is expected that the interim order will be extended to permit the exchange to resolve any outstanding matters.
