SCOTT WILLIAM BRADLEY SPENCE

 

WHEREAS:

 

(A)         On January 18, 2011, The Manitoba Securities Commission (“Commission”) issued a Notice of Hearing (“Notice”) giving notice of its intention to hold a hearing to consider whether or not orders should be made under The Securities Act, R.S.M. 1988, c. S50 as amended (“Act”) with respect to Scott William Bradley Spence (“SPENCE”) and/or Investia Financial Services Inc. (“INVESTIA”);

 

(B)         As a result of an appearance before a panel of the Commission on June 30, 2011, hearing dates were set for November 15th and 16th, 2011 commencing at 9:00 a.m. each day;

 

(C)         On August 4, 2011, a Notice of Discontinuance was issued discontinuing the proceedings against INVESTIA;

 

(D)         On November 15, 2011, the matter appeared before a panel of the Commission;

 

(E)         Upon hearing the submissions of counsel for staff of the Commission and the submissions of SPENCE appearing for himself, reviewing the documentary evidence submitted, and noting the consent of SPENCE to the making of this order, the Commission is of the opinion that it is in the public interest to make this order.

 

 

IT IS ORDERED:

 

1.                            THAT pursuant to section 148 of the Act, SPENCE be cease traded permanently.

 

2.                            THAT pursuant to subsection 19(5) of the Act, subsection 19(1) of the Act, with respect to such of the trades referred to in that subsection, and subsection 19(2) of the Act, with respect to such of the securities referred to in that subsection, do not apply to SPENCE permanently.

 

3.                            THAT pursuant to section 148.2 of the Act, SPENCE pay to Carl Monk the amount of $6,000.00.

 

4.                            THAT pursuant to section 148.2 of the Act, SPENCE pay to Andrew Paul Murdoch, also known as Paul Murdoch, the amount of $20,000.00.

 

5.                            THAT pursuant to section 148.2 of the Act, SPENCE pay to Stefan Szkwarek the amount of $10,000.00.

 

6.                            THAT pursuant to section 148.2 of the Act, SPENCE pay to Andriy Szkwarek the amount of $10,000.00.

 

7.                            THAT pursuant to section 148.2 of the Act, SPENCE pay to Christopher Durant the amount of $20,000.00.

 

8.                            THAT pursuant to section 148.2 of the Act, SPENCE pay to Greg Surek the amount of $11,351.19.
