DANIEL SCAMMELL

 

WHEREAS:

 

(A)         On May 14, 2012, the British Columbia Securities Commission (“BCSC”) issued a Decision against two respondents including Daniel Scammell (“BCSC Decision”);

 

(B)       On January 18, 2013, The Manitoba Securities Commission (“Commission”) issued a Notice of Hearing (“Notice”) giving notice of its intention to hold a hearing to consider whether or not it was in the public interest to grant orders pursuant to The Securities Act, R.S.M. 1988 c. S50 as amended (“Act”) with respect to, inter alia, Daniel Scammell (“SCAMMELL”);

 

(C)       On March 20, 2013, this hearing matter came before a panel of the Commission;

 

(D)       Upon reviewing the documentary evidence and hearing the submissions of counsel for staff of the Commission, no one appearing for the respondent SCAMMELL, and upon reviewing the Affidavit of Service, filed, and being satisfied as to service upon the respondent, the Commission is of the opinion that it is in the public interest to make this order.

 

IT IS ORDERED:

 

1.                            THAT, pursuant to section 148 of the Act, SCAMMELL cease trading in securities, except he may trade and purchase securities through accounts in his own name at one registered dealer, provided that he gives a copy of this order to the registered dealer.

 

2.                            THAT, pursuant to section 148.3 of the Act, SCAMMELL resign any position he holds as, and be prohibited from becoming or acting as, a director or officer of any issuer, other than an issuer all the securities of which are owned by SCAMMELL or by members of his immediate family.

 

3.                            THAT, the orders in paragraphs 1 and 2 above remain in force until the latest of May 14, 2017, the date that the Director receives confirmation of the amounts in paragraphs 6, 14, 18 and 20 of the BCSC Decision having been paid pursuant to the BCSC Decision, and the date the Director receives confirmation of SCAMMELL having paid the amount in paragraph 7 of the BCSC Decision.
