DTCC DATA REPOSITORY (U.S.) LLC

 

WHEREAS:

 

(A)       The Manitoba Securities Commission (the “Commission”) issued Order No. 7013 effective October 23, 2014 designating DTCC Data Repository (U.S.) LLC (“DDR”) as a trade repository under section 31.6(1) of the Act (the “Previous Order”);

 

(B)       AND WHEREAS DDR is subject to the terms and conditions of its designation order;

 

(C)       AND WHEREAS paragraphs 23, 24, 25 and 26 in the section titled (c) Provision of Data to the Commission in Schedule “A” Terms and Conditions of DDR’s designation order describe the provision of data by DDR to the Commission;

 

C)        AND WHEREAS the establishment of a Canadian securities regulatory authority as an agent of the Commission is required for the receipt, storage and aggregation of derivatives transaction data from DDR, and for the production of certain related reports;

 

(D)        AND WHEREAS the Commission is of the opinion that it is not prejudicial to the public interest to issue an Order that amends the Previous Order to permit the establishment of a Canadian securities regulatory authority to act as the Commission’s agent for the receipt, storage and aggregation of derivatives transaction data from DDR and for the production of certain related reports.

 

IT IS ORDERED:

 

(1)  THAT Order No. 7013 dated October 23, 2014 is amended by adding an additional paragraph at the end of the section titled (c) Provision of Data to the Commission in Schedule ‘A’ Terms and Conditions that states:

 

“In addition to providing the Commission with data as described in paragraphs 23, 24, 25 and 26 above, DDR will also provide similar access to a Canadian securities regulatory authority specified by the Commission, in writing, subject to any applicable laws and requirements governing the sharing of information and the protection of personal information.”
