Century 21 Reynard Real Estate Ltd.

WHEREAS:

(A) Application has been made to The Manitoba Securities Commission (the "Commission") by Century 21 Reynard Real Estate Ltd. (the "Applicant") for an order pursuant to section 47 of The Real Estate Brokers Act (the "Act") to permit the Applicant to advertise for sale certain real estate located in Ontario.

(B) The Applicant has represented to the Commission that:

1) The Applicant’s head office is located at 213 First St. S., Kenora Ontario, P9N 1C2:

2) The Applicant is not registered under the Act but is currently registered as a real estate broker in Ontario;

3) The Applicant conducts transactions in real estate in Ontario. This activity consists of selling of recreational properties in Ontario ("Ontario Properties").

4) The Applicant does not conduct transactions in real estate involving real estate located in Manitoba.

5) Section 44(1) of the Act prevents the Applicant from advertising Ontario Properties for sale in Manitoba.

(C) The Commission is satisfied that compliance with the Act would not advance the purposes of this Act, and that it would not be contrary to the public interest to make this order.

IT IS ORDERED:

1. THAT, pursuant to section 47 of the Act, the Applicant shall be exempt from the provisions of section 44(1) of the Act with respect to the advertising of Ontario Properties, subject to the following conditions:

a. Advertising of the Ontario Properties in Manitoba is limited to advertisements placed in a newspaper and/or a magazine of general circulation in Manitoba;

b. Except as permitted by this order, the Applicant does not conduct a transaction in real estate in Manitoba; and

c. The Applicant continues to be registered as a real estate broker in Ontario.

2. THAT, the fee for this order shall be $150.
