An Order Exempting
JA Crook Marketing Consultants Inc.

Background information

(A) JA Crook Marketing Consultants Inc. (the Applicant), a private corporation registered in the Province of Manitoba, has made application to The Manitoba Securities Commission (the Commission) for an order exempting certain activities from The Real Estate Brokers Act (the Act);

(B) The Applicant has represented to the Commission that:

1. The sole officer, director and shareholder of the Applicant is Jo Anne Crook, a resident of the City of Winnipeg;

2. The Applicant conducts telemarketing real estate research and market surveys (the Services) on behalf of real estate agents (Clients) who are registered under the Act;

3. The Applicant believes that the Services for the most part do not fall within the scope of the Act;

4. The Services include a question as to whether the person responding to the survey or someone known to that person may be selling or buying any real estate in the near future. This question may constitute conduct in the furtherance or attempted furtherance of a transaction in real estate within the meaning of the Act;

5. Follow up action with regard to the Services will be made by registrants under the Act;

(B) The Applicant is not registered under the Act and has no intention of applying for registration;

(C) The Commission is of the opinion that it would not be prejudicial to the public interest to grant the order requested.

IT IS ORDERED:

1. Pursuant to section 47 of the Act, the Applicant shall be exempt from the provisions of section 40 of the Act with respect to the Services on condition that all questions asked are of a general nature and do not recommend a specific person or company registered under the Act;

2. The fee for this order shall be $150.00.
