JOSE ANTONIO PEREIRA & MARIO

WHEREAS:

(A) On June 21, 2001, The Manitoba Securities Commission (the "Commission") received information that Jose Antonio Pereira ("Pereira") and Mario Manuel Lopes ("Lopes") committed fraudulent acts and offences against The Real Estate Brokers Act ("the Act");

(B) Pereira and Lopes are registered under the Act as real estate salesmen with Re/Max Real Estate Inc. ("Re/Max");

(C) Information has been received by staff of the Commission that a scheme has been used by Pereira and by Lopes whereby false gift letters have been used to obtain or to attempt to obtain mortgage financing in transactions in real estate;

(D) The Commission is of the opinion that in view of the foregoing there is cause to make this order and it is in the public interest to do so.

IT IS ORDERED:

1. THAT, pursuant to subsection 11(1) of the Act, Pereira’s registration as a salesman under the Act be suspended effective June 22, 2001 through to July 6, 2001, both dates inclusive. During the period of his suspension Pereira is to have no dealings with his clients or Re/Max or any of its agents in connection with trades or transactions in real estate.

2. THAT, pursuant to subsection 11(1) of the Act, Lopes’s registration as a salesman under the Act be suspended effective June 22, 2001 through to July 6, 2001, both dates inclusive. During the period of his suspension Lopes is to have no dealings with his clients or Re/Max or any of its agents in connection with trades or transactions in real estate.
