WHEREAS:

(A) On September 14th and 19th, 2001, a hearing was held by The Manitoba Securities Commission ("Commission") at the request of Jose Antonio Pereira ("Pereira") under subsection 29(1) of The Securities Act ("Hearing") for a hearing and review of the decision of the Registrar, of The Real Estate Brokers Act, ("Registrar") refusing to approve the transfer application of Pereira’s suspended registration under subsection 14(1) of The Real Estate Brokers Act;

(B) Upon reviewing the documentary evidence and upon hearing the submissions of Staff and of counsel for Pereira, the Commission issued Reasons for Decision dated September 26th , 2001;

(C) The Commission deems it proper that this Order be made.

IT IS ORDERED:

1.  THAT pursuant to subsection 29(2) of The Securities Act, the decision of the Registrar, of The Real Estate Brokers Act, refusing to allow the transfer is upheld.
