NANCY JANE BOHEMIER
WHEREAS:
(A) On December 4, 2018, a Notice of Hearing issued by reason of a Statement of Allegations of staff of The Manitoba Securities Commission (“Commission”) dated December 4, 2018, whereby the Commission gave notice of its intention to hold a hearing to consider whether or not orders should be made under The Real Estate Brokers (“Act”) with respect to Nancy Jane Bohemier (“BOHEMIER”);
(B) On January 16, 2019, this hearing matter came before a panel of the Commission and was adjourned to February 20, 2019;
(C) On February 20, 2019, this hearing matter again came before a panel of the Commission;
(D) Upon hearing submissions from counsel for staff and counsel for the respondent, the Commission is of the opinion that it is in the public interest to make this Order.
IT IS ORDERED:
1. THAT the respondent BOHEMIER provide disclosure to staff counsel by Friday, April 12, 2019 as follows:
(a) an Outline of the proposed case of the respondent;
(b) all documents intended to be relied upon by the respondent as evidence at the hearing;
(c) a list of witnesses the respondent intends to call; and
(d) witness statements as referred to in Part 3, clause 3.3(3), of the Pre-Hearing Procedures Policy of the Commission, namely:
a. the text of written statements made by witnesses intended to be called by the respondent; or
b. in the absence of a written statement, tape, or transcription of an interview, a summary of the anticipated testimony of the witness.
2. THAT in the event that the respondent intends to call an expert witness, the respondent comply with Part 3.5 of the Pre-Hearing Procedures Policy of the Commission by Friday, April 12, 2019.
