DARYL SCOTT NEWIS

 

WHEREAS:

 

(A)         A hearing was held by The Manitoba Securities Commission (“Commission”) on November 6, 2019, pursuant to an Amended Notice of Hearing dated June 14, 2019, and Amended Statement of Allegations of Staff dated June 14, 2019, to consider;

 

(1)          whether or not it is in the public interest to order, pursuant to subsection 11(1) of The Real Estate Brokers Act (“REBA”), that the registration of Daryl Scott Newis (“Newis”) under REBA be suspended or cancelled;

 

(2)          whether or not it is in the public interest that Newis be required to pay costs of and incidental to the hearing;

 

(3)          such further and other orders as the Commission may deem appropriate.

 

(B)         After reading the Amended Notice of Hearing and Amended Statement of Allegations of Staff, and upon hearing the evidence and submissions of staff and counsel for Newis, the Commission issued Reasons for Decision with respect to the Hearing held November 6, 2019;

 

(C)         The Commission is of the opinion that it is in the public interest to make this order.

 

IT IS ORDERED:

 

1.                            THAT, pursuant to subsection 11(1) of the Act, Newis’s registration as a salesman under the Act shall be suspended for a period of twelve (12) consecutive months from the date of this order.

 

2.                            THAT, Newis take and pass satisfactorily, at his own cost, and before he re-enters the profession at the end of the period of suspension, all modules of the Manitoba Real Estate Salespersons course.

 

3.                            THAT, Newis pay costs of $14,542.92 and these costs are to be paid, in full, prior to the end of the period of suspension and in any event before Newis may be re-instated as a real estate salesman.

 

4.                            THAT, Newis is to serve a period of six (6) months of strict supervision following re-instatement.  His employing broker is required to submit a monthly written report to the Registrar in such format as the Registrar may require.
